The Supreme Court declared, in a new Judgment of 2019, the possibility of extinguishing the use of the family home by living with a new couple in the family home.

And this to consider that, with the coexistence of the new couple, the home has ceased to be considered a family home to serve the purposes of a new family.

Despite this, great care must be taken if the home is the habitual residence of minor children, as well as housing must be provided to cover the accommodation needs of these minors.

For these reasons, each specific case will have to be analyzed; the causes for which the use of the domicile was initially attributed, as well as the causes that are alleged to request its extinction by means of the procedure of modification of measures.
